Understanding the Law
Most dwellings in the UK will have approved development rights. This allows for minimal development without the requirement for a planning application. This is determined by whether you want to live in the room permanently and other criteria. As long as this is not the case, you won’t need planning permission.
Development Rights
Unfortunately, you will have no approved development rights if you live in a flat, maisonette, or listed property. In rare situations, an article 4 condition may be attached to a house, limiting the available legal development rights. This information is easily accessible through the deeds of your home. Article 4 frequently limits additional construction on overdeveloped properties. But don’t worry, most houses enjoy complete development rights.
Garden Pod Location
Permitted development rights may change depending on where you reside. Planning approval is usually necessary if you want to put a structure in front of your property. You will need to get planning permission if you live in a conservation area, an area of exceptional natural beauty, or a national park. If you reside in an AONB or a national park, you must develop within 20 metres of any section of your home. If you are more than 20m away, you will be unable to surpass 10sqm.
Planning Permission Does Not Allow…
As previously stated, any structure you use as permanent housing will require planning permission. Buildings used for recreation, such as gyms, art studios, or children’s play areas, are permitted and do not require planning permission.
